RENTAL AGREEMENT AND RELEASE OF LIABILITY

ACKNOWLEDGEMENT/SAFETY/INSURANCE

I will accept full responsibility for the care of the listed equipment. I agree not to lend the listed equipment to others while it is in my possession, and that if I was to do so, and they suffered an injury or loss therefore, that is my responsibility alone.

I acknowledge that I am responsible for carrying my own insurance to cover medical care in the event of an accident and any third-party liability that may arise from the use of the listed equipment. No coverage is available from The Descent Snowboard & Ski Shop dba 970 Sports Rewind to insure me or the listed equipment from loss in case of damage, theft or other liability incurred in the use of the equipment.

ASSUMPTION OF RISKS/RELEASE OF LIABILITY

I AM AWARE OF THE RISKS ASSOCIATED WITH MY USE OF THE LISTED EQUIPMENT AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS AND POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS RESULTING THEREFROM. I hereby agree, freely and voluntarily, to ASSUME and accept ALL RISKS of death or injury to any part of user’s body while using this equipment.

To the fullest extent allowed by law, I hereby RELEASE this The Descent Snowboard & Ski Shop dba 970 Sports Rewind from ANY AND ALL RESPONSIBILITY OR LEGAL LIABILITY for any injuries or damages to any user of equipment rented and listed on this booking, whether or not such injuries or damages are caused by NEGLIGENCE or any other cause. I further agree that I WILL INDEMNIFY, HOLD HARMLESS AND NEVER SUE or make a claim against this store, its owner(s), employees and The Descent Snowboard & Ski Shop dba 970 Sports Rewind and that I will defend and indemnify them if any claim or action is pursued for any injuries or damages related to the rented equipment. I agree not to make a claim or sue for injuries or damages relating to any use of this equipment.

THEFT/LOSS/DAMAGE/DEPOSIT

I agree to pay insurance along with the rental fee if it is posted in the store. I also agree to treat the listed equipment with great care. I understand and agree that I am responsible for any and all damage to the listed equipment. This includes but is not limited to any form of loss, theft, or damage to the listed equipment or other rented equipment, other than normal wear and tear. I understand that I am responsible for damages involving engraving, marking, stickers, graffiti or other defacing of the rented equipment. If any rental equipment is damaged a fee will be determined at the time of return. Insurance fee covers base damage and/or binding breakage. Normal wear and tear are not considered damage. A valid credit card is required as security in case of theft or damage to the rental equipment. In case of loss, theft or damage, an amount will be charged to the credit card (being the replacement value of the listed equipment). The listed equipment will be considered stolen 24 hours after the close of business on the return date. I understand that if for any reason the listed equipment is not returned on the due date and I return it the next day, my credit charge will automatically be charged a $100.00 late fee in addition to normal rental costs after the due date. If for any reason any credit card charges are not approved, I will remain responsible for payment in full. This document constitutes the final and entire agreement regarding this transaction. If any part is found to be invalid or unenforceable, the remainder shall be given full force and effect.

THIS IS A CONTRACT, which provides a COMPREHENSIVE RELEASE OF LIABILITY, but it is not intended to assert any claims or defenses that are prohibited by law. The specific legal rights of the parties may vary from state to state.

Charges

Here's the lowdown on our tiered rental system. Your pickup day is on us! All parties that will be using the rental equipment must be present to complete any applicable paperwork and liability waivers, you cannot rent equipment for someone else!

For Daily/Seasonal Rentals - Please return items to the shop no later than 12pm the following day of your rental and for Seasonal Rentals April 14, 2025 .

All Ski replacement $500

All Snowboard replacement $500

All boot replacements $300

Pole replacement $40

Helmet replacement $30

Snowshoes $60

Returning equipment late is subject to extra day charges plus a $100 late fee if another customer’s rental is affected.

Cleaning, Damage & Replacement

The Descent Snowboard & Ski Shop dba 970 Sports Rewind does not provide insurance covering loss, damage, or theft of any equipment. The Insurance fee covers base damage and/or binding damage. All rental equipment is to be returned to the same condition it was rented -- clean, undamaged, and in full working order.

We will assess repairs based on the expense necessary to return the item to rentable condition. By signing this form, you agree to pay all necessary damage charges. This includes, but is not limited to: damage to ski bases/edges/bindings/etc, bent poles, broken buckles or laces on boots, damaged sleeping bags, torn tents, etc.

Please bring a valid Driver's License and Credit Card at pickup.In the event that item(s) are lost, stolen, or destroyed, the customer is responsible for the full replacement value of the item.

Clean off ALL equipment before returning to The Descent Snowboard & Ski Shop dba 970 Sports Rewind. Dirty equipment will be subject to a $25 cleaning fee, no exceptions. Wipe equipment dry with a towel to prevent corrosion of metal surfaces. To avoid charges, treat our demo equipment as if it was your own. 

Return Policy for Seasonals:

Due to having a small inventory, we will not be providing full refunds for seasonal equipment.  For the month of October to November 27th, we can provide a 75% refund.  November 28th to December 20th, we can provide a 50% refund.  December 21, 2024 through April 11, 2025, there will be no refund issued for any reason.  Thank you for your understanding and we hope that you have an EXCELLENT WINTER SEASON

Return Policy:

The Descent Snowboard & Ski Shop dba 970 Sports Rewind strives to provide exceptional customer service.

• There are no returns on rental/demo skis/snowboards/cross country/snowshoes.
• The item must be unused and in its original box/packaging with all of the tags attached.
• There are no returns accepted on ski/snowboard/cross country boots that has been used outside.  We encourage you to wear footwear around the house to ensure proper fit and sizing.
• There are no returns on ticket sales.
• All returns must be approved prior to leaving the store.  Returns made without a prior authorization can be subject to a 20% restocking fee.
• No returns on used gear.

• You may take advantage of our damage waiver to reduce your cost in case of damage, stolen or lost.
• By taking advantage of purchasing the waiver you agree on still paying half of the damage in case of lost or if your items got stolen.
• In case of damage, we will quote the price of the repair and we will ask you to pay half of it unless the half equals your purchased of the waiver.
• In case of no purchased waiver the full price of the items or repair will be charge to your credit card.

Legal Notice

All notices from The Descent Snowboard & Ski Shop to You may be posted on our Web site and will be deemed delivered within thirty (30) days after posting. Notices from You to The Descent Snowboard & Ski Shop shall be made either by regular mail, sent to the address we provide on our Web site, or first class mail to our address at:
Delivery shall be deemed to have been made by You to The Descent Snowboard & Ski Shop five (5) days after the date sent.

Shipping and Delivery

This does not apply to rentals. At this time, The Descent Snowboard & Ski Shop ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, The Descent Snowboard & Ski Shop ships merchandise to Canada and Mexico, but not to other international locations. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

International

Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. The Descent Snowboard & Ski Shop is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.

Sales Tax

The Descent Snowboard & Ski Shop charges sales tax for merchandise ordered on this Web site based on the applicable state sales tax rate and the location to which the order is being shipped.
